General business condition 2010
for Bernert-BeKaS s.r.o
Effective from 1. 8. 2010:
Part 1
Basic assumptions
• Following “General business conditions”(named GBC later) determine relations during selling goods to any client.
Part 2
Price, payment conditions, payment terms
1. All listed prices include VAT (for selling on Czech and EU market). Prices for wholesalers (price groups 1-4) do not include VAT. Prices also depend on Czech crown/Euro exchange rate and may change every day accordingly.
2. Sales are based on an order created by the client in the WWW shop.
3. The buyer is obligated to pay the stated price.
4. Acceptable methods of payment (valid for International delivery):
a) Credit/debit card payment.
b) Pay on delivery.
5. For orders of goods not listed as “in stock”, the standard time of delivery in this GBP is not valid. Such good will be delivered when they are available in the stock.
All listed prices are for information only. Prices are subject to change. In this situation we will inform the client by E-mail or by phone. We will wait until the client express his agreement with modified pricing before proceeding with the order. Without any client response, the order will be cancelled.
Part 3
Transport and shipping conditions (valid for international delivery)
1. Standard shipping is done by PPL (Partner Company of DHL).
2. Price for shipping will be given individually based on delivery address and weight of package.
3. Other methods of shipping are available. Please consult with us.
4. We usually ship the goods within 1-4 working days. We will inform the by E-mail buyer when the good is eventually out of stock.
Part 4
Disputes
1. All disputes arising from the interpretation or implementation of the present terms and conditions shall be the exclusive jurisdiction of the Czech Republic court of law.
Part 5
Information about goods
1. Some of the listed information is based on data from a primary producer. We cannot be fully responsible for the information validity. All photos are only illustrative and the final product can look a bit different.
Part 6
Buying agreement repudiation
Repudiation is possible only for goods not personally withdrawn by the client.
Based on Czech law rule 367/2000 repudiation is possible in 14 days from the good delivery. It is necessary to follow these points:
- Let us know the number of order, date of order and contact or bank account number for money return.
- Send the good to our address.
- The goods must not be used.
- The goods must not be damaged.
- The goods must be complete (including accessories, manual e.t.c.).
- You must send us documents related to purchase as well.
- We suggest you send by the help of deducible service. The sender is responsible for the proper delivery of the goods.
If all of these conditions are satisfied, we will return you the money during 14 working days from the receipt of the returned goods. If any of the conditions listed above are not satisfied, it will be impossible to accept order cancellation. In this case the goods will be returned to the purchaser and we will charge you the goods return cost.
Part 7
Final assignations
1. The listed GBC are valid for all orders made from Bernert-BeKaS s.r.o from the day of proclamation.
2. In dependence on the changes in law and in Bernert-BeKaS s.r.o marketing strategy, these conditions are subject to change. Such changes will be immediately listed on Bernert-BeKaS s.r.o WWW in the General business conditions section.
Part 8
Intellectual Property
All components of bekas.cz as well as the website itself are protected by international laws on intellectual property. It is strictly forbidden to use, distribute, copy, reproduce, modify, alter or transmit website materials, such as text, image or sound, without Bernert-BeKaS s.r.o prior written agreement. The brands and logos on the website are the property of Bernert-BeKaS s.r.o and are subject to authorization for their use. No right or license shall be granted for any of these components without the written authorization of Bernert-BeKaS s.r.o or third parties who own the rights to the brands or logos appearing on the website. Bernert-BeKaS s.r.o reserves the right to take legal action in the event of any infringement of its intellectual property rights, including criminal action.
This website may offer downloads for certain materials that remain the property of Bernert-BeKaS s.r.o under the application of the above provisions, and may only be used for the personal and private use of the person downloading them.
